The Genesis of the National Women Commission

The need for a dedicated body to address women's issues in India became increasingly apparent in the late 20th century. Mandate and Functions

• Investigating and examining all matters relating to the safeguards provided for women under the Constitution and other laws. This involves scrutinizing existing legislation and policies to identify gaps and areas for improvement.
• Presenting to the Central Government, annually and at such other times as the Commission may deem fit, reports upon the working of those safeguards. These reports provide valuable insights into the effectiveness of existing measures and recommend necessary changes.
• Making in such reports recommendations for the effective implementation of those safeguards for improving the condition of women by the Union or any State. The NWC actively advocates for the adoption of its recommendations by both the central and state governments.
• Reviewing, from time to time, the existing provisions of the Constitution and other laws relating to women and recommending amendments thereto so as to suggest measures to meet any lacunae, inadequacies or shortcomings in such legislations. This proactive approach ensures that laws remain relevant and responsive to the evolving needs of women.
• Taking up cases of violation of the provisions of the Constitution and of other laws relating to women with the appropriate authorities. The NWC acts as a watchdog, ensuring that instances of discrimination and violence against women are promptly addressed.
• Looking into complaints and taking suo moto notice of matters relating to:
  • Deprivation of women's rights
  • Non-implementation of laws enacted to provide protection to women and achieve the objective of equality and development
  • Non-compliance of policy decisions, guidelines or instructions aimed at mitigating hardships and ensuring welfare and providing relief to women, and taking up the issues arising out of such matters with appropriate authorities.
• Calling for special studies or investigations into specific problems or situations arising out of discrimination and atrocities against women and identifying the constraints so as to recommend strategies for their removal. The NWC conducts research to gain a deeper understanding of the challenges faced by women and develop effective solutions.
• Undertaking promotional and educational research so as to suggest ways of ensuring due representation of women in all spheres and identifying factors responsible for impeding their advancement, such as lack of access to housing and essential services, inadequate support services and technologies for reducing the drudgery of women and for increasing their productivity. The commission works to raise awareness about women's issues and promote their participation in all aspects of society.
• Participating and advising on the planning process of socio-economic development of women. The NWC ensures that women's concerns are integrated into national development plans.
• Evaluating the progress of the development of women under the Union and any State. The commission monitors the impact of government programs and policies on women's lives.
• Inspecting or causing to be inspected a jail, remand home, women's institution or other place of custody where women are kept as prisoners or otherwise, and taking up with the concerned authorities for remedial action, if found necessary. This oversight function helps to ensure the safety and well-being of women in custody.
• Funding litigation involving issues affecting a large body of women. The NWC provides financial support to women seeking legal redress for injustices.
• Making recommendations to the Government or any other authority for the removal of difficulties arising in the implementation of laws or in the execution of plans or policies designed to promote the welfare of women and to achieve equality and development for them.
